Benjamin C. Mizer, Former Acting Associate Attorney General, Joins Arnold & Porter
WASHINGTON, D.C., July 7, 2025 — Arnold & Porter announced today that Benjamin C. Mizer, formerly the Justice Department’s third-ranking official, has joined the firm as a partner in the Complex Litigation practice. Mizer will be resident in the Washington, D.C. office.
In welcoming Mizer, Ken Chernof, co-chair of the firm’s Complex Litigation group, said: “With his breadth and depth of experience handling sensitive and highly sophisticated litigation and appellate matters, Ben strengthens our practice’s ability to meet the evolving needs of our clients.”
Jim Herschlein, co-chair of the Complex Litigation group, added: “The wide-ranging nature of Ben’s roles in both government and private practice positions him to contribute meaningfully across various of our firm’s litigation practices, including financial fraud, antitrust, environmental, civil rights, and congressional investigations and public policy.”
Mizer brings over two decades of experience in both private practice and senior government positions, serving most recently as Acting Associate Attorney General. In that capacity, Mizer supervised 13 of the U.S. Department of Justice’s (DOJ) components, including all civil litigating and grantmaking divisions. Throughout his tenure at DOJ across two presidential administrations, Mizer held other key leadership positions, including as the head of the Civil Division, the head of the Office of Legal Counsel, and counselor to the Attorney General. He also served as the General Counsel of the U.S. Office of Personnel Management and as the Solicitor General of his home state of Ohio, where he ran Ohio’s litigation in the U.S. Supreme Court, the Sixth Circuit, and the Ohio Supreme Court. He was also previously a partner in private practice, focusing on appellate and complex litigation.
Mizer has argued three cases before the U.S. Supreme Court, securing two unanimous victories, and many others at the appellate level. He has won numerous awards for his brief writing and government service and is a member of the American Law Institute, the American Academy of Appellate Lawyers, and the Edward Coke Appellate Inn of Court.

Mizer earned his J.D. magna cum laude from the University of Michigan Law School, where he was Editor-in-Chief of the Michigan Law Review. He received his B.A. summa cum laude from the College of Wooster. He served as a law clerk to Justice John Paul Stevens of the U.S. Supreme Court and Judge Judith W. Rogers of the U.S. Court of Appeals for the D.C. Circuit.
