SEC v. Jarkesy: Implications of a Groundbreaking Decision
In one of the most significant rulings in the 90-year history of the Securities and Exchange Commission (SEC), the U.S. Supreme Court in Securities and Exchange Commission v. Jarkesy, stripped the SEC of its ability to seek civil penalties for securities fraud in administrative proceedings.
