Hawke Quoted in FundFire on SEC In-House Judges Process

Securities Enforcement Partner Daniel M. Hawke was quoted in a recent FundFire article, “Legal Challenges to SEC’s In-House Adjudication Process Mount.” The article discusses the challenges the SEC faces after courts in the recent Cochran and Jarkesy cases criticized the SEC’s use of administrative proceeds to bring enforcement actions, including questioning the constitutionality of the removal process for the Commission’s in-house judges. In the article, Hawke said these rulings pose “an existential threat to the SEC’s ability to use its administrative process to bring enforcement actions.”
