Magnani Quoted in Law360 on Section 230 of the Communications Decency Act
Thomas Magnani, head of the firm’s Technology Transactions practice and co-chair of the Technology, Media, & Telecommunications industry group, was quoted in the recent Law360 article, “How Big Tech's Section 230 Liability Shield Got Wider In NY.” The article discusses two cases heading to the Supreme Court which could determine how much Section 230 of the Communications Decency Act will protect large technology companies. The case is heading towards the Supreme Court after a decision by U.S. District Judge Jesse M. Furman.
Magnani explained that while Section 203 was originally meant to protect internet companies, Judge Furman’s decision reinforces its applicability in other situations. For example, Magnani said that Section 203 “shields online retailers from liability related to third-party marketing materials hosted on their websites.”
