Improved Transparency and Predictability Expected From TSCA Test Order Ruling, Prero Says

Environmental counsel Judah Prero was quoted in the Chemical Watch article, “Court vacates TSCA test order seeking toxicity data for 1,1,2-trichloroethane,” which discusses a recent ruling from the U.S. Court of Appeals for the District of Columbia Circuit which vacated a Toxic Substances Control Act (TSCA) test order for 1,1,2-trichloroethane. The court ruled that the U.S. Environmental Protection Agency (EPA) must revise the order to thoroughly justify the need to generate new data on the solvent.

Prero told Chemical Watch that the ruling establishes “marching orders” the EPA should follow when issuing a test order and that it also requires the agency to clearly explain how it decided to issue an order. Although the decision could potentially delay future test orders, the transparency and predictability that is now required by the EPA will “serve everyone better,” Prero added.
