Former DOJ Antitrust Division Director of Criminal Litigation Andre Geverola Weighs in on DOJ’s Approach to Algorithmic Pricing in GCR

Andre Geverola, head of the firm’s antitrust cartel defense practice, was recently quoted in the GCR article, “DOJ Adopts Restrained Approach Against RealPage.”
Geverola, who was the first Director of Criminal Litigation in the U.S. Department of Justice’s Antitrust Division, said that the DOJ’s complaint against software company RealPage suggests that simply using algorithmic pricing is not enough to support a criminal price-fixing claim. “Of course, this does not mean [the] DOJ would be unwilling to bring criminal cases involving algorithmic pricing, only that additional facts would be needed,” he added.
