Dr. Beatriz San Martin Talks Post-Brexit European IP Law With The Law Society Gazette
Intellectual Property and Technology partner Dr. Beatriz San Martin was recently quoted in The Law Society Gazette article, “Imitation Game.” The article discusses differences in UK and EU intellectual property laws since Brexit.
The EU’s new Unified Patent Court (UPC) offers an alternative to the UK Patents Court for patent litigation and “could become more of a threat to the US patent litigation landscape if it is seen as a place where you can litigate quickly, with quality, predictability and certainty at a lower cost than in the U.S.,” she said.
One potential area of divergence between the UK and EU, San Martin said, involves supplementary protection certificates (SPCs), which “extend the exclusivity on medicinal products after patent expiry for a maximum period of five years.” The EU, she said, “is looking to reform the process of obtaining SPCs, and they will be quite different to their UK equivalent.”
