Veteran Supreme Court Lawyer John Elwood Joins Arnold & Porter to Lead Appellate and Supreme Court Practice

June 24, 2019

WASHINGTON, DC, June 24, 2019 — Arnold & Porter announced today that John Elwood, a former Assistant to the US Solicitor General, has joined the firm as a partner in the Washington, DC office. Mr. Elwood will head Arnold & Porter's Appellate and Supreme Court practice.

Mr. Elwood, a former law clerk to Justice Anthony Kennedy (1996-1997), previously served as Assistant to the US Solicitor General (2002-2005) and Senior Deputy in the Office of Legal Counsel at the US Department of Justice (2005-2009). He joins Arnold & Porter following 10 years in private practice. Among other cases he has argued before the Supreme Court, Mr. Elwood represented the petitioners in Kellogg Brown & Root v. United States ex rel. Carter, involving False Claims Act (FCA) whistleblower issues, and in Elonis v. United States, considering the intersection of free speech, social media, and criminal threat statutes. The Court ruled for his clients in both cases. Mr. Elwood also won mandamus twice from different panels of the D.C. Circuit in little more than a year, successfully arguing that internal investigation documents generated under a corporate compliance program were protected by attorney-client privilege.

Mr. Elwood has appeared before most of the federal courts of appeals. He has successfully argued cases across a broad cross-section of subjects, and has particular experience in environmental law, the False Claims Act, government contracting, and federal criminal law.

Arnold & Porter Chair Richard M. Alexander said: "John is a highly respected appellate and Supreme Court advocate whom clients trust to handle their most challenging and complex issues. His extensive experience, coupled with his record of leadership, makes him the ideal person to lead our top-tier Appellate team."

"I am honored to join Arnold & Porter's Appellate and Supreme Court practice," said Mr. Elwood. "The firm has a deep bench of outstanding appellate lawyers who are known nationwide for successfully handling even the most difficult matters. I look forward to working with this talented group to represent our clients before the nation's highest courts."

Mr. Elwood has been recognized as a Law360 Appellate MVP, AmLaw Litigation Daily's Litigator of the Week, and one of Financial Times's North American Innovative Lawyers, among others. He has also been ranked by Chambers USA, Appellate Law (Nationwide) and recognized by The Legal 500 for Appellate (Supreme Court). He is a frequent contributor to SCOTUSblog, the premier Supreme Court blog.

Mr. Elwood earned his JD from Yale Law School, where he served as Senior Editor of The Yale Law Journal. He received his MA from King's College, with distinction, first in class, and his AB from Princeton University, summa cum laude, where he was elected to Phi Beta Kappa.
