Arnold & Porter Secures ITC Trade Secret Litigation Victory for Heraeus
Arnold & Porter secured a significant trade secret litigation victory at the International Trade Commission (ITC) for Heraeus GmbH and Heraeus Medical LLC over alleged business trade secrets relating to the sale of orthopedic bone cement. The Commission issued an opinion on June 23, 2021, affirming and adopting the Administrative Law Judge’s earlier February 11, 2021 decision after the ITC’s first full virtual trial conducted remotely via video because of restrictions due to the COVID-19 pandemic.
The Commission determined that Heraeus did not misappropriate trade secrets or engage in any tortious interference or false advertising, and further determined not to review the presiding Administrative Law Judge’s finding of no injury to a domestic injury.
