Arnold & Porter Represents Lummus Technology in Appellate Victory

March 21, 2025

Arnold & Porter recently secured a victory for Lummus Technology at the Texas Court of Appeals, which confirmed a previous jury verdict the firm obtained in favor of Lummus over a dispute involving an $8.5 million technology and asset purchase.

In January 2023, Arnold & Porter successfully represented Lummus—a global leader in process technologies for clean fuels, renewables, petrochemicals, polymers, and gas processing—in a jury trial in Montgomery County, Texas, against Siluria ABC. The dispute centered on a demonstration unit petrochemical plant in La Porte, Texas, an asset sold under an agreement between the two companies.

Siluria then appealed the trial court's award to Lummus of damages and attorneys’ fees, including the return of $1.5 million held in escrow.

On February 27, 2025, the Texas Court of Appeals heard oral arguments on the matter in Conroe, Texas, and on March 20, a three-judge panel unanimously affirmed the trial court's judgment and award in favor of Lummus.

The Arnold & Porter team was led by partner Tom Kruse and included senior associate Andrew Bergman, with co-counsel Courtney Giles of Baker McKenzie.
