Experience Highlights

  • Atlantic Richfield Company in successfully defeating at trial and then in subsequent motions for summary judgment mass tort claims by individuals alleging failure to warn and product defect in sale of lead pigment for use in paint.

  • ​​​​​​Philip Morris USA as trial counsel in the "Engle progeny" litigation and other individual smoking and health cases. Individual plaintiffs routinely seek compensatory and punitive damages in the tens of millions of dollars.

  • ​​​​​​Planned Parenthood, as lead trial counsel, in securing multimillion-dollar jury verdict, which was affirmed on appeal at the Ninth Circuit, on all claims against anti-abortion activists for RICO, trespass, fraud, illegal recording, and contract violations.

  • Sotheby's in defeating all claims in a three-week jury trial in the U.S. District Court for the Southern District of New York. The alleged fraud had been considered one of the largest art frauds in history, valued at up to $1 billion.

  • 7-Eleven in successful defense against purported class action claiming that 7-Eleven franchisees are employees of 7-Eleven and entitled to overtime and expense reimbursement.

  • New York Community Bancorp in a victory in a Department of Labor, Office of Administrative Law Judges administrative proceeding involving Sarbanes-Oxley whistleblower claims that was upheld by the Administrative Review Board and Second Circuit.

  • Boston Scientific in securing a US$158 million verdict following a patent litigation between competitors in the endoscopy space. The jury found that the plaintiff willfully infringed the asserted patents.

  • Lindt & Sprüngli, Ghirardelli Chocolate Company, and Russell Stover as trial counsel in securing a significant, $33.45 million verdict after a two-week jury trial in the Western District of Missouri involving breach of contract claims.

  • Major League Baseball as trial counsel in five-week hearing before the Copyright Royalty Board concerning the allocation of statutory royalties paid for the retransmission of broadcast signals.

  • Puritan’s Pride, a Nestlé subsidiary, in a consumer class action alleging false advertising and unfair competition concerning "Buy One Get One Free” promotions. Defeated all claims against our client in a trial of a certified class.
