The Supreme Court’s 2023-24 Term and the Banking Industry: From Loper Bright to Cantero
The recent Supreme Court term remapped the terrain of the administrative state, with ramifications that will likely take years to develop. Among the Court's decisions of particular importance to the banking industry, two stand out: the ruling in Loper Bright, which reshaped the deference accorded to regulatory agency interpretations and rulemakings, and the opinion in Cantero, which held the judiciary to an exacting standard for finding preemption of state law under the National Bank Act. Attorneys from our financial services and appellate practice groups will discuss the implications of these two Supreme Court rulings for national banks. The first half of the session will discuss Loper Bright and other cases that affect regulatory rulemaking and interpretation, while the second half will focus particularly on preemption of state law as applied to national banks.
