Our team of attorneys, many of whom are former prosecutors, presents a six-part webinar series to walk our clients through the entire scope of an investigation, from inception through resolution, so your company is prepared to respond if the government comes knocking. This series is focused on the life sciences industry and the particular issues that arise in an investigation.
Part V: Resolving an Investigation
Our fifth webinar will cover key aspects of resolving investigations for life sciences companies. We will focus on cooperation and self-disclosure, accountability and effective compliance programs, and state authority and the FDA’s role. We will also discuss maintaining privilege, handling parallel proceedings, considerations of collateral consequences (including Corporate Integrity Agreements and exclusions), and strategies for achieving declinations in criminal cases and dismissals in civil False Claims Act cases. We will conclude by discussing resolution and settlement negotiations, including the particularities of settlements with the HHS-OIG, Non-Prosecution Agreements, Deferred Prosecution Agreements, appeals within the USAO, and negotiations on charges, stipulated facts, and loss amounts.
