Daniel Asimow Recognized by Daily Journal in Top Antitrust Lawyers 2024 Report
San Francisco-based Antitrust/Competition partner Daniel Asimow was named to Daily Journal's 2024 “Top Antitrust Lawyers” report. The special feature annually profiles the top antitrust lawyers in California.
In the profile, Asimow discussed his successful defense of an exclusive dealing case brought by a competitor against clients Bayer Healthcare LLC and Elanco Animal Health. The case spanned five years of litigation and involved allegations of monopolization, tying, and exclusive dealing related to Bayer’s flea and tick products containing the active ingredient, imidacloprid. Asimow and the Arnold & Porter team ultimately persuaded the jury that numerous competing flea and tick treatments existed, and that Bayer did not hold significant market power in the relevant market. “The key to our success was persuasive fact and expert testimony and showing the jury that the plaintiff’s expert was ignoring evidence contrary to his made-for-litigation opinion,” Asimow told the publication.
Asimow also discussed his representation of the Oakland Raiders in antitrust litigation initiated by the City of Oakland, which concerned the Raiders’ relocation to Las Vegas. Asimow and the team “prevailed on multiple motions to dismiss and appeals in both federal court and in state court in Los Angeles,” successfully securing the dismissal of the City’s claims in both state and federal court, as well as appellate decisions upholding the dismissals.
This is the fifth time Asimow has been recognized by the Daily Journal in this area. He was previously recognized in 2020, 2021, 2022, and 2023.
